About this Privacy Policy

This Privacy Policy explains how LEGENDÀSRISCAS LDA., trading under the Nova Atlantic brand ("Nova Atlantic", "we", "us" or "our"), collects, uses, shares, retains and protects personal data in connection with www.novatlantic.pt (the "Website") and enquiries about our residential developments in Portugal.

It applies when you browse the Website, submit a contact form, request information, arrange a call or viewing, communicate with us by email or telephone, or interact with us as a prospective purchaser, investor, agent, supplier or business partner.

We process personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation or "GDPR"), Lei n.º 58/2019 of 8 August, Lei n.º 41/2004 of 18 August as amended, Decreto-Lei n.º 7/2004 of 7 January as amended, and other applicable Portuguese and European data-protection rules.

Where an authorised real-estate agency, project company, broker or other partner collects personal data directly for its own purposes, that organisation may act as an independent controller and will provide its own privacy information where required.

Personal data we collect

Depending on how you interact with us, we may collect:

– Identification and contact data, including name, email address, telephone number, country of residence, preferred language and preferred contact channel.

– Enquiry and preference data, including the development, location or property type that interests you, your indicative timing, viewing preferences and the content of your message.

– Appointment and correspondence data, including requested meeting times and records of relevant email, telephone or other communications.

– Professional data where you contact us as an agent, supplier, contractor, adviser, investor or business partner, including company, role and professional contact details.

– Technical and usage data, including IP address, approximate location derived from it, browser and device information, pages visited, referral source, access date and time, security logs, cookie identifiers and consent choices.

– Marketing preference data, including whether you have asked to receive or stop receiving Nova Atlantic news and property updates.

– Information received from authorised brokers, introducers, property portals, event organisers or advisers where they lawfully introduce you to us.

The public Website forms do not ask for identity documents, tax information, payment details or anti-money-laundering documentation. If an enquiry develops into a reservation or property transaction, additional information may be requested through an appropriate secure process and may be covered by additional privacy information.

Please do not send health information, political opinions, religious beliefs, biometric data or other special-category personal data through free-text fields. The Website is directed to adults and is not intended for children.

How we collect personal data

– Directly from you when you use a form, email us, call us, request a meeting or otherwise communicate with us.

– Automatically from your browser or device through strictly necessary technologies and, only after consent, analytics technologies described in the Cookie Policy.

– From authorised agents, brokers, property portals, event organisers, introducers, professional advisers or project partners involved in your enquiry.

– From publicly available professional sources where relevant to a genuine business-to-business enquiry and permitted by law.

If we obtain your personal data from a source other than you, we will provide the information required by Article 14 GDPR within the applicable period, unless a legal exception applies.

Purposes and legal bases

We use personal data only for defined purposes and where a lawful basis applies:

Respond to enquiries — use contact details and message content to answer questions and send requested brochures, plans, specifications, availability or pricing information. Legal basis: steps taken at your request before a possible contract; legitimate interest in responding to genuine enquiries.

Arrange calls, meetings and viewings — use contact and scheduling data to organise and follow up appointments or site visits. Legal basis: pre-contractual steps; legitimate interest in managing client relationships.

Support a reservation or transaction — coordinate requested pre-contractual steps with the relevant project, sales, legal or administrative team. Legal basis: pre-contractual or contractual necessity; legal obligation where applicable.

Send marketing communications — send Nova Atlantic news, launches, events or property updates when you choose to receive them. Legal basis: consent. You may withdraw it at any time.

Operate and secure the Website — maintain hosting, forms, logs, backups, fraud prevention, error detection and cybersecurity. Legal basis: legitimate interest in secure and reliable systems; legal obligation where applicable.

Measure and improve the Website — use consented analytics to understand visits, content performance and usability. Legal basis: consent for non-essential analytics cookies.

Meet legal and compliance duties — keep required records, respond to authorities, manage complaints and establish, exercise or defend legal claims. Legal basis: legal obligation; legitimate interest in protecting legal rights.

Where we rely on legitimate interests, we consider the necessity of the processing and balance our interests against your rights and reasonable expectations. You may object as explained below.

Whether you must provide personal data

Providing data through the Website is voluntary. Fields marked as mandatory are the minimum needed to identify and answer your request. If you do not provide them, we may be unable to respond or arrange the service you requested. Optional fields help us provide a more relevant response.

Marketing communications

We will send electronic marketing to new contacts only where we have a valid lawful basis, normally your freely given consent. Any marketing checkbox must be optional, unticked by default and separate from the contact-form submission. Service, legal and transaction-related communications are not marketing and may continue where necessary.

Recipients and data sharing

We do not sell personal data. We may share it only where necessary with:

– Authorised Nova Atlantic personnel and the project company relevant to your enquiry.

– Authorised sales agents, real-estate mediation partners, brokers or introducers involved in your enquiry.

– Hosting, website, form, email, storage, analytics, consent-management, CRM and cybersecurity providers acting under appropriate contractual safeguards.

– Lawyers, notaries, solicitadores, accountants, auditors, tax advisers, banks and other professional advisers where a transaction or legal matter requires it.

– Public authorities, regulators, courts or law-enforcement bodies where disclosure is required by law or necessary to protect legal rights.

Processors acting for us are required to process personal data only on documented instructions, maintain confidentiality and apply appropriate security measures. Independent controllers are responsible for their own processing and privacy notices.

International transfers

We aim to process personal data within the European Economic Area ("EEA"). Where a service provider processes data outside the EEA, we use a lawful transfer mechanism such as an adequacy decision, the European Commission's Standard Contractual Clauses with supplementary measures where appropriate, or another safeguard permitted by Chapter V GDPR. You may request information about applicable safeguards by contacting us.

Retention

We keep personal data only for as long as needed for the stated purpose and then for any period required by law or necessary for legal claims. Our standard approach is:

General enquiries that do not progress — up to 24 months after the last substantive interaction.

Marketing consent and preferences — until consent is withdrawn or you object, plus a minimal suppression record so the opt-out continues to be respected.

Appointment and business correspondence — for the duration of the active matter and normally up to 24 months after the last substantive interaction, unless it becomes contractual or legally relevant.

Reservation, contract and transaction records — for the relationship and the applicable legal, tax, accounting, anti-money-laundering and limitation periods.

Website security and server logs — for a limited period proportionate to security, troubleshooting and incident-investigation needs.

Cookie and consent records — for the cookie duration stated in the Cookie Policy and for as long as reasonably necessary to demonstrate the consent choice.

Data may be retained longer where required by law, a regulator, a court order, an active dispute or the establishment, exercise or defence of legal claims. When no longer required, data is deleted or irreversibly anonymised.

Your rights

Subject to the conditions and limits in applicable law, you may request:

– Access to your personal data and information about how it is processed.

– Correction of inaccurate data and completion of incomplete data.

– Erasure where a ground under Article 17 GDPR applies.

– Restriction of processing in the circumstances set out in Article 18 GDPR.

– Portability of data you provided where the processing is automated and based on consent or contract.

– Objection to processing based on legitimate interests and an unconditional objection to direct marketing.

– Withdrawal of consent at any time, without affecting processing already carried out lawfully.

– Review of any decision based solely on automated processing that produces legal or similarly significant effects, although we do not currently make such decisions through the Website.

We normally respond within one month; the GDPR allows an extension of up to two further months for complex or numerous requests, in which case we will inform you within the first month.

If you believe that your personal data has been processed unlawfully, please contact us so we can address the matter. You also have the right to lodge a complaint with:

Security

We apply technical and organisational measures appropriate to the risk, including access controls, secure transmission, authentication, data minimisation, confidentiality duties, backups, service-provider due diligence and incident-management procedures. No internet transmission is completely risk-free, but we review and improve safeguards as technology and risks develop.

Automated decision-making

We do not use personal data collected through the Website to make decisions based solely on automated processing that produce legal or similarly significant effects. Consented analytics are used to understand Website performance and not to decide whether an individual may buy or invest.

Children

The Website is intended for adults and is not directed to children. We do not knowingly collect children's personal data for property marketing. If you believe a child has provided personal data, contact us so we can assess and, where appropriate, delete it.

Third-party websites

The Website may link to development websites, including www.greenhills.pt, mapping services and social-media platforms. Those services are governed by their own privacy information. Following an external link does not make Nova Atlantic responsible for the third party's content or privacy practices.

We may update this Privacy Policy to reflect legal, technical or business changes. The current version will remain available on the Website and will show its last-updated date. If a change requires a new consent, we will request it before carrying out the relevant processing.
